Update on Ontario’s Upholstered and Stuffed Article Regulation

The Government of Ontario announced Bill 66 to revoke the Upholstered and Stuffed Articles regulation under TSSA (Technical Standards and Safety Act). They are targeting July 1, 2019 for the bill to become effective.

The bill will eliminate Ontario’s specific requirements for Upholstered and Stuffed Articles and remove the enforcement role of the TSSA for these items in the Province of Ontario only.

Please also be advised that upholstered and stuffed articles will still need to comply with the legislation under the Federal Canada Consumer Product Safety Act and Textile Labelling Act.

The Provinces of Manitoba and Quebec will still regulate Upholstered and Stuffed Articles and there are no changes scheduled for these provinces. Registration and disclosure of hidden filling materials will still be required for Manitoba and Quebec.

In addition, there is federal legislation which protects consumers against health and safety issues relating to all types of consumer products. For example, under the Toy Regulation of the Canada Consumer Product Safety Act, there are additional requirements for filling that must be clean, free of vermin, free of sharp material and non-toxic.

Upholstered and stuffed articles will still be subject to the Consumer Protection Act in Ontario. This Act prohibits misleading descriptions of products claiming new material when a used material has been used. Misrepresentation of a product is an offence under the Act and subject to prosecution and possibly a civil claim.
