CPSC Issued Direct Final Rule Revising 16 CFR 1308 Phthalate Determination

The current phthalate determination rule of 16 CFR 1308 relieves the manufacturer’s obligation to have specific listed plastics and additives tested by a CPSC-accepted third party conformity assessment body.

On January 26, the U.S. Consumer Product Safety Commission (CPSC) issued a direct final rule revising the phthalates listed in the determination rule of 16 CFR 1308 to align them with the phthalates in 16 CFR 1307, phthalates final rule, which becomes effective April 25, 2018. The phthalates rule of 16 CFR 1307 regulates children’s toys and child care articles manufactured or imported with DEHP, DBP, BBP, DINP, DIBP, DPENP, DHEXP, DCHP.

The direct final rule for 16 CFR 1308 becomes effective on April 25, 2018 unless the Commission receives a significant adverse comment by February 26, 2018.
